The Maison Scarlett website sells the following products: jewelry boxes, watch boxes, jewelry holders, jewelry displays and accessories.
Confirmation of an order constitutes unconditional acceptance of these general terms and conditions of sale.
Article 1 – Principles
These GTC set out the entirety of the parties’ obligations.
They apply to the exclusion of all other terms and are available on the Maison Scarlett website, where they prevail over any other conflicting document.
The seller reserves the right to amend its Terms and Conditions from time to time; they shall apply as soon as they are published online.
Article 2 – Scope of application
These Terms and Conditions govern the online sale of goods offered by the seller through the Maison Scarlett website, for deliveries to the countries offered at the time of ordering on the website. Eligible areas, delivery times, and delivery costs are specified when the cart is validated.
For any delivery request outside these areas, the customer may contact contact@maison-scarlett.fr.
Article 3 – Pre-contractual Information
The buyer acknowledges having received, prior to placing the order, all information required under Article L.221-5 of the French Consumer Code, including the essential characteristics of the goods, the price, costs, delivery times and terms, legal guarantees, and the conditions for exercising the right of withdrawal.
Article 4 – Order
Orders are placed online, subject to available stock.
To be validated, the buyer must accept the Terms and Conditions, provide the delivery address, choose the shipping method and confirm payment.
The sale becomes final and binding:
-
after order confirmation is sent by email,
-
and after full payment of the price.
In the event of non-payment, an incorrect address, or an anomaly, the seller may suspend the order until the issue is resolved.
Any question relating to an order may be sent to: contact@maison-scarlett.fr
Article 5 – Electronic signature
Final confirmation and provision of payment details constitute an electronic signature and express acceptance of the order and these GTC.
Article 6 – Order Confirmation
An order confirmation is sent by email after payment has been confirmed.
Article 7 – Proof of the transaction
Computerized records, kept in the seller's systems under reasonable security conditions, constitute proof of communications, orders, and payments between the parties.
Article 8 – Products
The products offered for sale are those displayed on the website, subject to available stock.
They are described and presented as accurately as possible, but photographs are not contractually binding.
Article 9 – Prices
Prices are stated in euros, including all taxes, excluding delivery charges.
Shipping costs are specified before the order is confirmed.
The seller reserves the right to change its prices at any time, while guaranteeing the price in force at the time of the order.
In the event of changes to taxes or contributions, such changes may be passed on to prices.
Discount codes cannot be combined with each other or applied to products already benefiting from a promotion.
Article 10 – Payment and retention of title
10.1 Payment methods
Payment is due in full when the order is placed.
Accepted payment methods are: credit card (Visa, Mastercard, Amex...), ApplePay, PayPal, and Klarna (installment or deferred payment subject to the conditions displayed).
The seller may refuse any order in the event of a prior payment dispute.
10.2 Security
Payments are processed by approved service providers using secure protocols.
10.3 Retention of Title
The seller retains ownership of the goods until full payment of the price.
The transfer of risk takes place upon delivery.
Article 11 – Availability and delivery times
Shipping times begin on the order registration date shown in the confirmation email.
For pre-order products, the indicative delivery period is specified on the product page; failing this, it may not exceed 30 days unless otherwise agreed.
In the event of delay, the buyer may require the seller to perform within a reasonable additional period; failing this, the buyer may terminate the contract.
Refunds of amounts paid are issued within 5 days at the latest.
If a product is unavailable, the buyer will be informed and may request a refund or exchange.
Year-end holiday period:
Any order placed before December 18 will be delivered before Christmas.
Orders placed after December 18 are placed with the understanding that delivery times may be extended.
Article 12 – Delivery
Delivery corresponds to the transfer to the customer of physical possession or control of the goods.
Products are delivered to the address provided when the order is placed; any error or omission in this address is the buyer’s responsibility.
Any parcel returned due to an incorrect address will be reshipped at the buyer’s expense.
In the event of absence, a delivery notice is left.
If the parcel arrives damaged, the buyer must:
-
refuse delivery or make specific reservations on the delivery note,
-
notify the seller without delay.
Any return must be requested within 60 days of delivery.
Products must be returned complete and intact (packaging, accessories, instructions), and we cover the return costs.
Deliveries outside the EU (e.g., Switzerland): import duties and taxes are the responsibility of the recipient and cannot be refunded.
Article 13 – Delivery errors / non-conformity
Any claim regarding an error or non-conformity must be made on the day of delivery or, at the latest, on the following business day, by email to: contact@maison-scarlett.fr.
The seller will then assign a return number.
All returns must be made in the original packaging, complete and in good condition.
Article 14 – Legal Warranties
14.1 Conformity guarantee (French Consumer Code)
The seller is liable for defects in conformity under the conditions set out in Articles L.217-3 to L.217-14 of the French Consumer Code.
The consumer has 2 years from delivery of the goods to take action and may choose between repair or replacement, unless the cost is disproportionate.
The consumer is not required to prove the existence of the defect within 24 months following delivery of the new goods.
14.2 Warranty against hidden defects (Civil Code)
In accordance with Articles 1641 et seq. of the Civil Code, the buyer may take action within 2 years from discovery of the defect and choose between cancellation of the sale or a price reduction.
14.3 Commercial Warranty
Any commercial warranty is indicated on the relevant product page and is in addition to the legal warranties above.
Article 15 – Right of withdrawal (60 days)
The consumer has a period of 60 days from receipt to exercise their right of withdrawal, without having to provide a reason.
Products must be returned in their original condition and complete, allowing them to be resold as new.
Damaged or incomplete products will not be accepted for return.
The request may be sent by email to contact@maison-scarlett.fr.
In the event of exercising the right of withdrawal:
-
the price of the product(s) and the initial “standard” delivery charges shall be refunded;
-
the return costs remain the responsibility of the customer.
The refund will be issued within 14 days of receipt of the returned products.
Free products provided as part of an order
Where the order has resulted in the granting of one or more free products (promotional gifts, items included free of charge in a pack or special offer), their return is mandatory with the returned product(s).
Otherwise, the refund will be refused or reduced by the commercial value of the unreturned free products.
Exceptions (Art. L221-28 of the French Consumer Code): personalized goods, unsealed for hygiene reasons, digital content performed before the end of the withdrawal period, etc.
Article 16 – Force majeure
Any external, unforeseeable and irresistible event suspends the obligations of the parties.
If the force majeure event lasts more than 3 months, either party may terminate the contract.
Article 17 – Intellectual Property
The elements of the website (texts, images, graphics, logos, videos, sounds…) are protected and remain the exclusive property of the seller.
