Article 1 – Principles
These GTC set out the entirety of the parties’ obligations.
They apply to the exclusion of all other terms and are available on the Maison Scarlett website, where they prevail over any other conflicting document.
The seller reserves the right to amend its Terms and Conditions from time to time; they shall apply as soon as they are published online.
Article 2 – Scope of application
These Terms and Conditions govern the online sale of goods offered by the seller through the Maison Scarlett website, for deliveries to the countries offered at the time of ordering on the website. Eligible areas, delivery times, and delivery costs are specified when the cart is validated.
For delivery requests outside these areas, customers may contact contact@maison-scarlett.fr.
Article 3 – Pre-contractual Information
The buyer acknowledges having received, prior to placing the order, all information required under Article L.221-5 of the French Consumer Code, including the essential characteristics of the goods, the price, costs, delivery times and terms, legal guarantees, and the conditions for exercising the right of withdrawal.
Article 4 – Order
Orders are placed online, subject to available stock.
To be validated, the buyer must accept the Terms and Conditions, provide the delivery address, choose the shipping method and confirm payment.
The sale becomes final and binding:
-
after an order confirmation has been sent by email,
-
and after payment in full of the price has been received.
In the event of non-payment, an incorrect address, or an anomaly, the seller may suspend the order until the issue is resolved.
Questions about an order may be sent to: contact@maison-scarlett.fr
Article 5 – Electronic signature
Final confirmation and provision of payment details constitute an electronic signature and express acceptance of the order and these Terms and Conditions of Sale.
Article 6 – Order Confirmation
An order confirmation is sent by email once payment has been approved.
Article 7 – Proof of the transaction
Computerized records, kept in the seller's systems under reasonable security conditions, constitute proof of communications, orders, and payments between the parties.
Article 8 – Products
The products offered for sale are those displayed on the website, subject to available stock.
They are described and presented as accurately as possible, but the photographs are not contractually binding.
Article 9 – Prices
Prices are shown in euros, including all taxes, excluding shipping costs.
Shipping costs are specified before the order is confirmed.
The seller reserves the right to change its prices at any time, while guaranteeing the price in force at the time of the order.
In the event of changes to taxes or contributions, such changes may be passed on to prices.
Discount codes cannot be combined with each other or applied to products already benefiting from a promotion.

For preordered products, the estimated delivery time is stated on the product page; if none is stated, it may not exceed 30 days unless otherwise agreed.
In the event of a delay, the buyer may require the seller to fulfill its obligations within a reasonable additional period; if the seller fails to do so, the buyer may terminate the contract.
Amounts paid will be refunded within a maximum of 5 days.
If a product is unavailable, the buyer will be informed and may request a refund or exchange.
Year-end holiday period:
All orders placed before December 18 will be delivered before Christmas.
Orders placed after December 18 are placed with the understanding that delivery times may be longer.
Article 12 – Delivery
Delivery occurs when physical possession or control of the item is transferred to the customer.
Products are delivered to the address provided when the order is placed; any error or omission in this address is the buyer’s responsibility.
Any package returned because of an incorrect address will be reshipped at the buyer’s expense.
In the event of absence, a delivery notice is left.
If the parcel arrives damaged, the buyer must:
-
refuse delivery or note specific concerns on the delivery slip,
-
notify the seller without delay.
All returns must be requested within 60 days of delivery.
Products must be returned complete and undamaged (including packaging, accessories, and instructions), and we cover the return shipping costs.
Deliveries outside the EU (e.g., Switzerland): import duties and taxes are the recipient’s responsibility and are nonrefundable.
Article 13 – Delivery errors / non-conformity
Any claim concerning an error or lack of conformity must be submitted on the day of delivery or no later than the following business day, by email to: contact@maison-scarlett.fr.
The seller will then assign a return number.
All returns must be made in the original packaging, complete and in good condition.

14.1 Conformity guarantee (French Consumer Code)
The seller is liable for lack of conformity under Articles L.217-3 to L.217-14 of the French Consumer Code.

Under Articles 1641 et seq. of the French Civil Code, the buyer may bring a claim within 2 years of discovering the hidden defect and choose between cancellation of the sale and a price reduction.

Any commercial warranty is indicated on the relevant product page and is in addition to the legal warranties above.
Article 15 – Right of withdrawal (60 days)
Consumers have 60 days from receipt to exercise their right of withdrawal without giving a reason.
Products must be returned in their original condition and complete, so they can be resold as new.
Damaged or incomplete products will not be accepted for return.
Requests may be sent by email to contact@maison-scarlett.fr.
In the event of exercising the right of withdrawal:
-
the price of the product(s) and the original “standard” shipping costs are refunded;

-
The refund will be issued within 14 days of receiving the returned products.
Free products provided as part of an order

Otherwise, the refund will be denied or reduced by the retail value of any complimentary products not returned.
Exceptions (Art. L221-28 of the French Consumer Code): personalized goods, goods unsealed for hygiene reasons, digital content supplied before the end of the withdrawal period, etc.
